Lurgaboy Adventure

1. Applicability of Terms & Conditions

These Terms & Conditions shall be incorporated into the contract and shall apply in place of, and prevail over, any terms and conditions contained or referred to in any communication from the customer, or implied by custom or practice.

 

2. Booking Conditions

A contract is formed once Lurgaboy Adventure acknowledges acceptance of the customer’s booking form and required payment.

Please note:
A booking is not confirmed until you have received written confirmation by email from Lurgaboy Adventure.

 

3. Late Bookings

Late bookings may not guarantee a place on a course or activity.
No booking is confirmed until confirmation has been issued by email from Lurgaboy Adventure.

 

4. Participation & Risk

Participation in adventurous activities involves a degree of risk. All staff employed by Lurgaboy Adventure are trained and appropriately qualified and will operate activities in a manner intended to minimise risk. However, customers must accept that accidents and injuries can occur.

  • Any participant under the age of 18 must have explicit permission from a parent or legal guardian.
  • Parents/guardians must be aware of and accept the risks involved in adventure activities.
  • Customers are responsible for the safekeeping of all equipment issued. Except for fair wear and tear, Lurgaboy Adventure reserves the right to charge for lost or damaged equipment.
  • All participants must always follow safety instructions and regulations.
  • All bookings are subject to availability and acceptance of these Terms & Conditions.
  • Any current price list supersedes all previous price lists.

 

5. Fees & Payment

  • Places are only reserved once Lurgaboy Adventure has received:
    • A completed booking form and full payment, or
    • A completed booking form and an official purchase order from a recognised buying authority, upon which an invoice will be issued.
  • Full payment is required no later than 4 weeks before the programme commences.
  • The full programme fee is required to reserve a place.
  • Accepted payment methods:
    • Visa and Mastercard (debit and credit)
  • Payments are debited on receipt of the booking form.
  • Payments are non-refundable, except as outlined in Section 6 (Cancellation).
  • Late payments may incur statutory interest under the Late Payment of Commercial Debts (Interest) Act 1998.
  • Dishonoured cheques will incur a £25 administration fee.
  • Cheques should be made payable to “Lurgaboy Adventure” and sent to:
    12 Gosford Road, Armagh, Northern Ireland, BT60 1LQ
  • No payment reminders will be issued.

 

6. Cancellation by the Customer

All cancellations must be made in writing by post or email.
Cancellations will be acknowledged within 5 days. Until confirmation is received, the booking remains valid.

Cancellation charges are as follows:

  • More than 4 weeks before start date:
    Full refund less £25 administration fee
  • Less than 4 weeks but more than 2 weeks:
    50% of total fee
  • Within 2 weeks of start date:
    75% of total fee
  • On or after start date:
    100% of total fee

 

7. Cancellation by Lurgaboy Adventure

Lurgaboy Adventure reserves the right to cancel activities where necessary due to unsafe or unsuitable conditions.

Where possible, customers will be notified:

  • As soon as practicable in cases of safety concerns
  • At least 10 working days prior where minimum numbers are not met

In the event of cancellation, customers will be offered:

  • A full refund, or
  • An alternative date

 

8. Health & Medical Information

Participants must be of good general health and capable of taking part in sometimes strenuous outdoor activity.

  • All medical conditions, disabilities, injuries, or illnesses must be declared during booking.
  • Any changes in health prior to the activity must be reported.
  • Participants must ensure participation is within their own capabilities.
  • Medical advice should be sought where necessary.
  • Lurgaboy Adventure reserves the right to refuse participation on medical grounds where safety may be compromised.

 

9. Dietary Requirements

Any special dietary requirements must be declared at the time of booking.
Lurgaboy Adventure cannot guarantee accommodation of dietary needs at short notice.

 

10. Safety Regulations

Outdoor activities take place in natural environments with inherent hazards.

Participants must comply with:

  • All safety instructions
  • Guidance provided by instructors
  • Site rules and procedures

Failure to comply may result in withdrawal from the activity.

 

11. Unruly Behaviour & Exclusion

Any behaviour that disrupts the safe or smooth running of an activity may result in exclusion without refund.

Any damage caused to equipment or property will be charged to the responsible party.

 

12. Personal Property

Personal property always remains the responsibility of the customer, unless loss or damage results from proven negligence by Lurgaboy Adventure.

 

13. Complaints Procedure

Any issues should be raised immediately with:

  • The instructor
  • Course leader
  • Management

If unresolved, complaints should be submitted in writing to:

All written complaints will be addressed within 28 days.

 

14. Limitation of Liability

  • Lurgaboy Adventure limits liability to the maximum extent permitted by law.
  • Public liability insurance is held.
  • Personal accident insurance is not provided and must be arranged by the customer if required.

15. Photography & Media

Photographs taken during activities may be used on the Lurgaboy Adventure website and social media.

If you do not wish to be photographed, please inform the instructor at the time of the activity.

 

16. Data Protection

Personal data is collected solely for booking, delivery, and quality assurance purposes.

  • Data may be stored electronically and accessed by authorised personnel.
  • Contact details may be used for future communications.
  • Customers may opt out of marketing communications at any time.

 

17. Applicable Law

These Terms & Conditions are governed by the laws of Northern Ireland.
Any disputes shall fall under the jurisdiction of the courts of Northern Ireland.

Statutory consumer rights are not affected.

 

18. Definitions

  • Customer: Any person or organisation booking services from Lurgaboy Adventure
  • Service: Any activity, course, or facility provided
  • Contract: Agreement between Lurgaboy Adventure and the customer
  • Statutory Interest: As defined by the Late Payment of Commercial Debts (Interest) Act 1998
  • Terms & Conditions: These Terms & Conditions of provision
